Bir tanesi henüz yürürlüğe giremese de 1976 tarihli Avrupa Seçim Yasası bugüne kadar iki kez değişikliğe uğramış ve Avrupa Parlamentosu, Mayıs 2022’de Avrupa Seçim Yasasını yürürlükten kaldırmak için yeni bir Konsey tüzüğü önerisi kabul etmiştir. Temel çıkış noktası seçimlerin “Avrupalılaşma”sı olan bu öneri ile Avrupa Parlamentosu seçimlerinin ulusötesi aday listesi, Spitzenkandidaten prosedürü, tüm üye devletlerde yeknesak bir seçim sistemi gibi radikal değişikliklerle yapılması hedeflenmektedir. 2010 yılından itibaren Birliğin içinde bulunduğu kriz döneminin Birlik vatandaşlarının talep ve görüşlerinin gözardı edilmesinden kaynaklandığı düşünüldüğünde Avrupa seçim yasasında yapılması önerilen bu değişikliklerle siyasi partilerin doğrudan Avrupa meselelerine odaklanması ve böylece seçmenlerin de Birlik için en beğendikleri seçim programına oy verme imkanları söz konusu olabilecektir. Her ne kadar Avrupa Birliğinin İşleyişi Hakkındaki Antlaşma m. 223’de öngörülen prosedür nedeniyle yürürlüğe girip girmeyeceği belli olmasa da Avrupa Parlamentosu tarafından kabul edilen önerinin Birliğin geleceğinin belirlenmesinde önemli bir kilometre taşı olduğu düşünülmektedir.
Although one of the amendments has not been entered into force yet, the European Electoral Act is amended twice until today and the European Parliament adopted a new legislative initiation proposal to repeal the European Electoral Act with a new Council regulation in May 2022. With this proposal, whose main purpose is the “Europeanization” of the elections, it is aimed to implement the European Parliament elections with radical changes such as transnational electoral lists, Spitzenkandidaten procedure, and a uniform electoral system in all member states. Considering the crisis period that the Union has been in since 2010 is due to the ignorance of the demands and the views of the Union citizens, the amendments proposed for European election law will enable political parties to focus directly on European issues, and thus the voters will have the opportunity to vote for their favorite election program for the Union. Although it is not clear whether it will enter into force or not due to the conditions laid down in Article 223 of the Treaty on the Functioning of the European Union, the proposal accepted by the European Parliament is thought to be an important milestone in determining the future of the Union.
